Welcome to Cima Real Estate, accessible at www.cimarealestatetx.com (the “Site”). The Site is owned and operated by Cima Real Estate, a Dallas-based real estate company specializing in owner-financed homes (“Cima Real Estate,” “we,” “our” or “us”).

These Terms and Conditions (the “Agreement”), together with our Privacy Policy and SMS Terms, govern your access to and use of the Site and all services we offer through it (collectively, the “Site Offerings”). By accessing or using the Site Offerings in any way, you agree to this Agreement in full. If you do not agree, you are not authorized to use the Site Offerings.

Scope & Modifications

This Agreement represents the complete understanding between you and Cima Real Estate regarding your use of the Site Offerings and replaces any prior agreements on the same subject. We reserve the right to update or modify this Agreement at any time. Changes will be posted on this page with an updated date. Your continued use of the Site Offerings after any update constitutes acceptance of the revised terms.

Modifications to any dispute resolution or arbitration provisions will not apply retroactively to disputes that arose before the change was made.

Eligibility & Access Requirements

The Site Offerings are available only to individuals who are at least 18 years of age and legally capable of entering into binding contracts under applicable law. If you are under 18, you may not access or use the Site Offerings.

You are solely responsible for maintaining the equipment, software, and internet connection needed to access the Site. Cima Real Estate does not guarantee that the Site will be accessible on all devices, browsers, or wireless plans. Standard internet, data, and carrier rates may apply and are your responsibility entirely.

Site Offerings & Contact Forms

Through the Site, you may submit inquiry forms to request information about available owner-financed properties, career opportunities, or our referral program. When you submit a form, you authorize Cima Real Estate to contact you by phone, email, or text in connection with your request.

Information you may be asked to provide includes:

  1. Your full name
  2. Your phone number
  3. Your email address
  4. Your preferred zip code or area of interest
  5. A resume or work history, if submitting a career inquiry
  6. Any other details requested on a specific form

After you submit a form and we follow up with you, we may ask for additional details to help match you with suitable properties. How we handle the information you provide is described in our Privacy Policy.

Cima Real Estate does not guarantee that every inquiry will result in a property match or a successful transaction. We reserve the right to decline any inquiry at our sole discretion. If Cima Real Estate terminates this Agreement for any reason, we have no further liability to you.

Referral Program

If you submit a referral inquiry through the Site, Cima Real Estate may contact you to discuss participation. Acceptance into the referral program is at Cima Real Estate‘s sole discretion, and submitting an inquiry does not guarantee enrollment. The specific terms governing any referral arrangement will be set out in a separate agreement at that time. Cima Real Estate is not liable for any modification, suspension, or termination of the referral program.

Third Party Service Providers

Some services or products accessible through the Site may be offered by independent third-party providers (“Third Party Service Providers”). Cima Real Estate does not directly provide these third-party offerings, and we make no representations about their availability, suitability, or terms. Any transaction or agreement you enter into with a Third Party Service Provider is solely between you and that provider.

Cima Real Estate is not liable for any claims, losses, or disputes arising from your use of, or inability to qualify for, any third-party product or service. We encourage you to review the terms and privacy policies of any Third Party Service Provider you engage with independently.

Cima Real Estate may receive compensation from Third Party Service Providers whose services are referenced through the Site. This compensation may influence which providers are featured.

Your Responsibilities

You are solely responsible for your interactions with Cima Real Estate, any Third Party Service Providers, and any other parties you connect with through the Site Offerings. In the event of a dispute with any such party, you agree to release Cima Real Estate from all related claims, demands, and damages of any kind, whether known or unknown.

You represent and warrant that: (a) this Agreement constitutes a valid and binding obligation enforceable against you; and (b) you have independently assessed the Site Offerings and have not relied on any representation not expressly stated in this Agreement.

Limited License to Use the Site

You are granted a personal, non-exclusive, non-transferable, revocable license to access and use the Site Offerings for your own lawful, non-commercial purposes. This license does not permit you to:

  • Copy, reproduce, or distribute any part of the Site
  • Reverse engineer, decompile, or modify any software underlying the Site
  • Use automated tools to scrape, extract, or compile data from the Site
  • Interfere with or disrupt the operation of the Site or its servers
  • Transfer or sub-license your access rights to any other person

Cima Real Estate reserves all rights not expressly granted here and may terminate this license at any time without notice.

Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Cima Real Estate or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. Nothing in this Agreement grants you ownership of or rights to any content on the Site. Unauthorized use, reproduction, or distribution of any Site content is strictly prohibited.

The Cima Real Estate name, logo, and associated marks are trademarks of Cima Real Estate. All other trademarks referenced on the Site belong to their respective owners. Use of any trademark without prior written consent from the owner is not permitted.

Prohibited Conduct

Any attempt to damage, disrupt, tamper with, or compromise the Site Offerings or the systems that support them is a violation of both civil and criminal law. Cima Real Estate will actively pursue all available legal remedies against any individual or entity responsible for such conduct.

Indemnification

You agree to defend, indemnify, and hold harmless Cima Real Estate and its officers, directors, employees, and agents (collectively, the “Covered Parties”) from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  1. Your use of the Site Offerings
  2. Any breach of this Agreement by you
  3. Any dispute between you and a Third Party Service Provider
  4. Any violation of another person’s or entity’s rights by you

Each of the Covered Parties may enforce this provision directly against you.

Disclaimer of Warranties

THE SITE OFFERINGS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, Cima Real Estate DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Cima Real Estate DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR PROPERTY OR OUTCOME WILL BE AVAILABLE OR ACHIEVED THROUGH THE SITE OFFERINGS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Cima Real Estate SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OFFERINGS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL. IF APPLICABLE LAW DOES NOT ALLOW SUCH LIMITATIONS, Cima Real Estate‘S MAXIMUM LIABILITY TO YOU UNDER ANY CIRCUMSTANCES SHALL NOT EXCEED FIVE HUNDRED DOLLARS ($500.00).

The Site may include links to third-party websites or resources. Cima Real Estate does not control those sites and is not responsible for their content, availability, or practices. Linking to a third-party site does not constitute an endorsement by Cima Real Estate. You access any external site at your own risk.

Social Media

The Site may link to Cima Real Estate‘s pages on third-party social media platforms. Your use of those platforms is governed by each platform’s own terms and policies, not this Agreement. Cima Real Estate is not responsible or liable for anything that occurs through your use of those platforms.

SMS & Text Messaging Terms

The Cima Real Estate SMS program sends text messages related to property availability, appointment updates, marketing communications, and other account notifications to subscribers who have provided express consent.

Program: Cima Real Estate SMS Alerts

Message Frequency: Message frequency varies based on your activity and preferences.

Rates: Message and data rates may apply. Contact your carrier for details.

Opt Out: Reply STOP, QUIT, END, CANCEL, or UNSUBSCRIBE to opt out at any time.

Help: Reply HELP or call (469) 770-7478 for support.

Consent: Consent to receive SMS messages is not required as a condition of purchasing any property or receiving any service from Cima Real Estate.

Privacy: View our Privacy Policy and SMS Terms.

Supported Carriers: The Cima Real Estate SMS program is supported on most major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, and Boost Mobile, as well as many regional carriers. Carriers are not liable for delayed or undelivered messages.

Dispute Resolution

This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under or related to this Agreement or the Site Offerings shall first be submitted through a written notice to Cima Real Estate describing the issue in detail. If the matter cannot be resolved informally, both parties agree to submit the dispute to binding arbitration before JAMS, in the county where you reside.

For claims of $10,000 or less, you may choose whether the arbitration takes place in person, by phone, or based on written submissions. Any arbitration award shall be final and may be entered as a judgment in any court of competent jurisdiction.

You agree not to bring or participate in any class action lawsuit or class arbitration against Cima Real Estate or any Covered Party. You may opt out of these dispute resolution provisions by sending written notice to Cima Real Estate within 30 days of first accessing the Site.

General Provisions

If any part of this Agreement is found to be invalid or unenforceable, that portion will be interpreted as closely as possible to the original intent, and the remainder of the Agreement will continue in full force. Our failure to enforce any provision of this Agreement at any time is not a waiver of our right to enforce it in the future.

Cima Real Estate may assign its rights and obligations under this Agreement to any third party at any time without notice to you. You may not assign your rights or delegate your obligations under this Agreement. This Agreement is personal to you and governs your use of the Site Offerings. Nothing in this Agreement creates an agency, partnership, or joint venture between you and Cima Real Estate.
